Temporary Public Policy allowing Visitors to Apply for A Work Permit from Within Canada Extended.

Immigration, Refugees and Citizenship Canada (IRCC) issued a temporary public policy[1] which took effect on 24 August 2020, allowing certain temporary residents with visitor status to apply for a work permit from within Canada. Initially, visitors were expected to be in Canada on the day the policy came into effect to benefit. However, on 1 April 2021, IRCC updated the public policy advising of its extension to 31 August 2021 and expanded the eligibility criteria to allow visitors in Canada to apply for an employer-specific work permit regardless of when they entered Canada, but on or before 31 August 2021; those who held a work permit within the last 12 months of applying may also request interim authorization to work while the application is being processed.[2]


Visitors who wish to apply for a work permit under the public policy must ensure that they have valid temporary resident status as a visitor, submit an employer-specific work permit application on or before 31 August 2021 and remain in Canada after submitting the application. Where a former temporary foreign worker converted to visitor status and wants to apply under the public policy for permission to work pending a decision on the application, they must: meet the aforementioned requirements, have held a work permit within the last 12 months of submitting an application, intend to work for the employer in the occupation specified in the offer of employment and request interim authorization to work until a decision is rendered on the application.[3]


Applicants who have engaged in work without authorization may still benefit from the temporary public policy; the prohibition on the issuance of work permits stipulated by R.200(3)(e) of the Immigration and Refugee protection Rules has been waived.[4]
